Data protection

Welcome to the privacy policy of baesh social UG (haftungsbeschränkt), referred to here as baesh. Here you can learn how we collect, store, protect and share your information, and with whom we share information. We encourage you to read this Privacy Policy and our Terms and Conditions.

While you use baesh's app, our websites and microsites (such as baesh.co), or our digital products and services (such as our contests or surveys) (collectively referred to in this Privacy Policy as our "Sites"), we collect some information about you. In addition, you may choose to use the App or the Sites to share information with other users, including your friends and contacts ("Users" or "Users"). We may also need to share your information at times.

 

1. COLLECTION OF INFORMATION

Registration Information

When you install the App and create a profile, we collect some or all of the following information ("Registration Information") about you:

Name;

Username;

Email address;

Gender Identity;

Date of Birth;

Photos;

Once you have registered, you can review and change this information at any time by simply logging into baesh (with the exception of your date of birth and gender identity). It is your responsibility to ensure that your account information is kept up to date. 

The information we collect helps improve the app and verify our users (bots are not welcome!). Registration information such as your name is visible to other users who see your profile page.

 

Profile Information

We recommend and encourage you (and all of our members) to think carefully about the information you disclose about yourself. We also do not recommend that you include email addresses, URLs, instant messaging details, phone numbers or addresses, credit card details, national identity numbers, driver's license details, and other sensitive information that is open to misuse in your profile.

If you upload information about yourself or use the Messenger feature to communicate with other users, you do so at your own risk.

 

Profile verification information (including biometric data)

For security reasons and to provide you with the best possible user experience, we require our users to verify their accounts and ask for your email address. 

Location Services Information

If you have given baesh access to your location in your device settings, we collect information about WiFi access points and other location information about your latitude and longitude when you use your phone, and may store the coordinates of your device to provide you with certain features. This information helps us identify your physical location, and we use it to personalize the App and make it easier for you to interact with other users by allowing general location information to be displayed to users who see your profile and to show you the profiles of other users who are near you.

 

baesh success stories, surveys and other contributions.

From time to time, we conduct surveys for research purposes and we may contact you to find out if you would like to participate. We may also contact you to find out if you would like to give us feedback, provide a testimonial, or participate in marketing campaigns. Such surveys and marketing campaigns are voluntary and further information will be provided at the time of contact. If you do not wish to be contacted to participate in a survey or marketing campaign, please contact our customer support team through our feedback page.

 

2. USE OF INFORMATION

Our main goal is to make your baesh experience as pleasant as possible. To provide this experience, we use your information to:

Provide you with services and features;

Contact you with information about the app (e.g., updates and new features);

Personalize the app/sites and the content we deliver to you;

To conduct research and analysis about how you use and interact with the App/Sites;

Test new technologies and processes designed to enhance and improve the App/Sites;

Resolve disputes, troubleshoot problems, and enforce our Terms and Conditions;

Investigate fraud, protect our legal rights, and enforce our Terms and Conditions;

Protect our users and third parties from harm.

 

Our matching algorithm

We have developed matching algorithms to predict your compatibility with events and to show you activities that match your interests. Our matching algorithms use the following data about you to assess your compatibility with others and generate profile recommendations: the interests you tell us about yourself in your profile. If you have chosen to include sensitive information in your profile, such as information about your personal beliefs, the processing of that information is based on your voluntary and explicit consent.

Moderation Practices

We use a team of moderators to monitor and review accounts (including photos and other information uploaded to user profiles) and messages for content that may indicate violations of our Terms of Use. If an account or message meets certain criteria indicating that the Terms of Use are likely to have been violated, the account in question will be issued with a warning and the user's access will be restricted and/or blocked. Affected users may contact baesh to appeal the decision.

If you post something that is inconsistent with our Terms of Use, we reserve the right to terminate or restrict access to your account.

 

Legal basis

Under EU and German data protection laws, we are required to tell you our legal basis for using your data and we have set this out in the table below. If the legal basis requires consent, you may withdraw your consent at any time. If the legal basis is a legitimate interest, you have the right to object to the use of your data. We explain in the relevant sections of this Policy how you can withdraw your consent or object to certain data uses (if applicable).

3. PROVIDING INFORMATION

In accordance with our policy, we do not share your registration information or personal information except in the limited circumstances set forth herein:

Circumstances under which information may be shared

Moderators - To monitor activity in the app and approve content.

Law and Damages - As we mentioned in our GTC, we believe it is very important that all users behave properly when using the app. We will cooperate with any third parties to enforce their intellectual property or other rights. We will also cooperate with law enforcement authorities inside or outside the country where you reside if we are required to do so by law, if there is an investigation into suspected criminal conduct, or to protect a person's vital interests. This may include retaining or disclosing your information, including your registration information, if we have a good faith belief that such action is necessary to comply with a law or regulation or if we believe disclosure is necessary:

  • To comply with a judicial proceeding, court order, or legal request;

  • to protect the security of any person;

  • to address fraud, security or technical issues, such as anti-spam providers, to protect the Service from criminal activity;

  • or to protect our rights, property or those of others.

 

In such cases, we may assert or waive any legal defenses or rights available to us.

Disclosed Data
 

Name and registration data of the user, profile information, content of messages and photos

This could include any personal information baesh holds about you, depending on the nature of the request or issue we are dealing with.

4. WHAT OTHERS CAN SEE ABOUT YOU

When using baesh, please always assume that anything you publish or post through the app may be publicly available, both to app users and non-users. We want our users to be careful when posting information that will eventually become public.

Your baesh profile and other information you provide through the App may be viewed by and shared with people who may or may not be users of the App. For example, a user can view your event  recommend to his friends by taking a screenshot of your profile picture and sharing it, regardless of whether the friend(s) are also users of the app. Or he uses the share function to share your event with other people via a link.

5. OUR AGE POLICY

We would like as many people as possibleYou can enjoy our app, but to use baesh you must be at least 16 years old.

6. SAFETY
​

Unfortunately, no website or Internet transmission is completely secure. Therefore, we can never guarantee that unauthorized access, hacking, data loss and other incidents can be completely ruled out. Here are a few useful tips that can help protect your data:

  1. Please make sure to log out of your account after use as you never know who could access your account.

  2. Please do not share the password you use to access your baesh account with other people.

  3. Change your password regularly.

7. INFORMATION FOR EVENT MEMBERS

 

Please note that event members can only see the chat discussions once they join the respective event and thus also the chat. When they join the chat, they can see the entire chat history

8. YOUR RIGHTS

​

The data protection laws applicable in your country may give you the following rights:

  1. Right to information: What personal data a company processes and why (we provide this information in the privacy policy).

  2. Right to information: You can request information about collected data.

  3. Right to rectification: If data collected is incorrect, you can request rectification.

  4. Right to deletion: Under certain circumstances you can request that your data be deleted.

  5. Right to restrict processing: Under certain circumstances, you can request that further processing of your data be stopped, but the data will continue to be stored.

  6. Right to data portability: You can have certain collected data handed over to you in a machine-readable format in order to forward it to another provider.

  7. Right to object: In certain circumstances (including where your data is being processed based on legitimate interests or for marketing purposes) you can object to processing.

  8. Rights in relation to automated decisions in individual cases, including profiling: This includes several rights when data is processed exclusively by automated means and this has legal or significant effects on an individual. In these circumstances, you have, among other things, the right to human intervention in the decision-making process.

The specific rights that apply to you (which may include other rights not listed above) may vary by country. You should inform yourself about the rights you have under the applicable data protection laws in your country.

9. STORAGE LOCATIONS

In order to be able to offer our service, we operate a server in Germany.

10. DATA STORAGE AND DELETION

 

We will only retain your personal data for as long as we need it for the legal basis asserted and as permitted by applicable law. 

If your account is deleted, we ensure that it is no longer visible in the app. It is still possible to recover your account if it was accidentally deleted for up to 28 days. After 28 days, we will begin deleting your personal information from our systems unless:

  1. we must retain them to comply with applicable law 

  2. we need to retain it to demonstrate our compliance with applicable laws (for example, if a profile is suspended, we will retain some information about the profile and a record of the behavior that led to the suspension - this information will be retained for evidence purposes in the event of any queries or there are legal claims regarding the blocking);

  3. There is an outstanding issue, claim or dispute which requires us to retain the relevant information until it is resolved; or

  4. the information must be retained for our legitimate business interests, such as preventing fraud and improving user security (e.g., information must be retained to prevent a user who has been banned for risky behavior or security incidents from opening a new profile).

Caution: Even if you remove information from your profile or delete your account, copies of that information may still be visible and/or accessible to the extent that that information was previously shared or copied with others, stored by other users, or linked to search engines. We cannot control this and accept no liability for it. If you have given third-party applications or websites access to your personal information, they may retain such information in accordance with their terms of use or privacy policies.

 
11. CHANGES TO THESE TERMS

As baesh continues to develop, we may occasionally revise the Privacy Policy. If we make changes to the Terms that we, in our sole discretion, consider to be material, we will notify you, for example by sending you an email to the address registered in your profile or by posting a notice on baesh.
