General terms and conditions of baesh

Here you will find the General Terms and Conditions ("GTC") of baesh social UG (haftungsbeschränkt), herein referred to as baesh. As soon as you access, view or use the App, you are legally bound to comply with these Terms and Conditions.

1. baesh Guidelines

​

You can register with baesh manually. For more information about what information we use and how we use it, please see our Privacy Policy. By using our app, you acknowledge that we may collect and use your data and information in accordance with our Privacy Policy.

Unfortunately, we cannot allow you to use another person's account or share your account with another person without permission.

baesh offers plenty of ways to have fun, but if you want to delete your profile, you can do that at any time. Just go to the settings and select "delete profile". Your profile will be deleted immediately, but it may take a while for your content (as defined below) to be completely removed from the app. Your profile information will be handled in accordance with our Privacy Policy. If you delete your account and attempt to create a new account with the same credentials within this time period, we will reactivate your account for you.

We use a team of moderators to monitor accounts and messages for content that may indicate violations of these Terms. We reserve the right, in our sole discretion, to delete or suspend any profile, restrict access to the App, or take any operational, technical, legal or other action at any time, without liability and without notice, to ensure compliance with the TOS (which includes, without limitation, blocking specific IP addresses). Without limiting the foregoing in any way, we expressly reserve the right to terminate or suspend your Account without notice (1) for breach of these Terms, (2) based on your conduct in the App or your conduct with other App users (including your "offline" conduct) if we determine, in our sole discretion, that your conduct was inappropriate or unacceptable, (3) if we or our partners determine, in our or their sole discretion, that your conduct on other Apps operated by our partners was inappropriate or unacceptable, or (4) for any reason we determine, in our sole discretion, warrants termination of the Account. If your account is terminated or suspended.

You may not access, tamper with, or use non-public areas of the App or our systems. Certain parts of the App may not be accessible if you have not registered for an account.

2. TYPES OF CONTENT

In the app, you have access to three types of content:

1. Content uploaded and provided by you ("Your Content");

2. content provided by other users ("content of other users") and

3. baesh-provided content (including, without limitation, database(s) and/or software) ("Our Content").

Certain content is not allowed on baesh.

Our users should be free to express themselves and post at baesh as they please, but we must draw boundaries when the content:

• Contain language or images that could be considered offensive or likely to harass, annoy, embarrass, alarm or disturb another person (including, without limitation, language that could be considered discriminatory against a person's color, ethnicity, national origin, religion, disability, sexual orientation, gender identity or physical appearance);

• Obscene, pornographic, violent, or otherwise likely to offend human dignity (e.g., including without limitation: language that may be deemed discriminatory against a person's color, ethnicity, national origin, religion, disability, sexual orientation, gender identity, or physical appearance);

• are offensive, hurtful, threatening, discriminatory, or promote or encourage racism, sexism, hatred, or bigotry (including, without limitation, language that may be deemed discriminatory against any person on the basis of color, ethnicity, national origin, religion, disability, sexual orientation, gender identity, or appearance);

• Promote any type of unlawful activity, including without any limitation: terrorism, incitement to discrimination, or a submission of what in itself constitutes the commission of a crime;

• Is libelous or defamatory;

• include the sending of "junk" or "spam";

• contain any form of spyware, adware, viruses, corrupted files, programs or other destructive code designed to interrupt, damage or limit the functionality of any software, hardware, telephone systems, networks, servers or other equipment, or which contains a Trojan horse or any other form of material designed to harm, disrupt, or expropriate data and personal information, whether from baesh or otherwise; or

• in itself or by publication infringe the rights of third parties (this includes, without limitation, intellectual property rights and personal rights);

• show another person and were created or disseminated without the consent of the data subject;

• are harmful to minors; or

• impersonate another person, including misrepresenting one's name.

baesh practices a zero-tolerance policy for this type of content.

Your contents

You may not publish any personal contact or banking information on the individual profile page, neither your own data, nor data of other persons (for example names, addresses or postal codes, telephone numbers, e-mail addresses, URLs, details of credit/debit cards or bank details). If you choose to disclose personal information about yourself or others, whether by email or otherwise, you do so at your own risk. We encourage you to exercise the same degree of caution in disclosing personal information as you would in other circumstances.

You agree that your content may be seen by other users as well as people who have participated in or received a link to the app (e.g., people who received a link to an event or shared content from other baesh users). 

Contents of other users

Other baesh users also share their content through the app. The content of other users is the property of the respective person who publishes the content. It is stored on our servers with the consent of the user providing the content and made publicly available via the app.

You have no rights to the content of other members and may only use the personal information of other baesh users to the extent that it is consistent with the purpose of baesh as a dating platform. You are not allowed to use other users' information for commercial purposes, sending spam, harassment, stalking or unlawful threats. In case of misuse of information about other users, we reserve the right to delete your profile.

 

Our contents

You might be wondering who owns the rest of the content at baesh. Quite simply: us! All other text, content, graphics, user interfaces, trademarks, logos, sounds, images and other intellectual property displayed on baesh, as well as the baesh software and database(s), are owned, controlled or licensed by us and are protected by copyright, trademark, data, database rights and/or other intellectual property rights. All rights in our content remain with us at all times.

We grant you a non-exclusive, limited, personal, non-transferable, revocable license - with no right to sublicense - to access and use our content, subject to the following conditions:

1. you may use, sell, modify or distribute our content only to the extent permitted by the features of the app;

2. you may not use our name as a metatag or keyword and/or in hidden text;

3. you may not create any products derived from our content or scrape, disable, decompile, analyze or in any way commercially exploit our content in whole or in part; and

4. you may use our content for lawful purposes only.

All other rights reserved.

No requirement to pre-screen content.

Because baesh is an online community, we generally try not to interfere and therefore do not assume any obligation to pre-screen your Content or any Member Content. However, there may be times when we need to intervene, and we reserve the right to review, pre-screen, reject and/or remove Member Content and your Content, including Content exchanged between users in direct messages.

3. RESTRICTIONS FOR THE APP

You agree:

• Comply with all applicable laws, including but not limited to privacy laws, intellectual property rights, anti-spam laws, equal opportunity laws and legal requirements;

• use your real name and age when creating your account and on your profile; and

• to use the service in a professional manner.

You agree that you:

• you do not act unlawfully or unprofessionally, and you are not dishonest, offensive or discriminatory;

• do not misrepresent your identity, your age;

• Do not share information that you do not have permission to share;

• not stalk or harass other users of the app;

• Do not create or operate a pyramid scheme, scam, or other similar practice; or;

• Do not develop, support or use software, devices, scripts, robots, other types of mobile code or other means or processes (including crawlers, browser plug-ins and add-on or other technologies) to scrape or otherwise exfiltrate baesh or its Services or copy profiles and other data from the Services.

We are against any kind of inappropriate behavior in our community. You can report abuse or complaints about member content by contacting us and giving us a brief description of the abuse or complaint. You can also report a user directly from a profile or chat by clicking on the 'Block & Report' link. We reserve the right to investigate possible violations of these Terms, the rights of any baesh User, or the rights of any third party, and we may, in our sole discretion, terminate a User's right to use the App without notice, as described in Section 1 above, and/or remove objectionable, infringing, or otherwise unauthorized Member Content posted to the App.

We have no control over the things our users say or do. You are therefore solely responsible for your interactions with other users of the app.

 

You agree, and hereby do, to indemnify, defend and hold harmless baesh and its successors and assigns from and against any and all claims, demands, losses, damages, rights and actions of any kind, including personal injury, death and property damage, arising either directly or indirectly from your interactions with or conduct of other users of the App. 

 

4. DATA PROTECTION

For information about how baesh collects, uses and discloses your personal information, please see our Privacy Policy. By using baesh, you consent to our use of your information in accordance with our Privacy Policy.

 

 

 

5. DISCLAIMER OF LIABILITY

IN ADDITION, WE DO NOT WARRANT THAT THE APP OR SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT YOUR USE OF THE APP OR SITE WILL MEET YOUR EXPECTATIONS, OR THAT THE APP, SITE, OUR CONTENT, MEMBER CONTENT, OR ANY PART THEREOF WILL BE CORRECT, ACCURATE, OR RELIABLE. YOUR USE OF THE APP OR WEBSITE IS AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. Baesh IS NOT RESPONSIBLE FOR ANY USER'S CONDUCT. Baesh DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON YOUR MEMBERS. IN ADDITION, WE DO NOT WARRANT THAT THE APP OR WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE OR FREE OF SECURITY VULNERABILITIES, THAT THE APP OR WEBSITE WILL MEET YOUR EXPECTATIONS, OR THAT THE APP, WEBSITE, OUR CONTENT, MEMBER CONTENT, OR ANY PORTION THEREOF IS ACCURATE, CORRECT, OR RELIABLE. YOU USE THE APP OR WEBSITE AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. Baesh ASSUMES NO RESPONSIBILITY FOR THE CONDUCT OF ANY USER. WE DO NOT REQUIRE POLICY LEADERSHIP FROM baesh MEMBERS.

6. LIMITATION OF LIABILITY

NEITHER WE NOR ANY INDIVIDUAL COMPANY OWNER WILL BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF DATA, REVENUE, PROFIT OR GOODWILL, LOSS OF OR DAMAGE TO PROPERTY OR CLAIMS, ANY THIRD PARTY CLAIM ARISING OUT OF YOUR USE OF THE APP, WEBSITE, OUR CONTENT OR ANY MEMBER CONTENT, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INFRINGEMENT OF PROPRIETARY RIGHTS, PRODUCT LIABILITY CLAIMS OR OTHERWISE.

THE FOREGOING APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. IF AT ANY TIME YOU ARE DISSATISFIED WITH THE APP OR WEBSITE, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE APP OR WEBSITE.

7. RELEASE FROM LIABILITY

​

You are responsible for all actions taken and information disclosed by you on baesh. Therefore, you agree to indemnify, defend and hold us and our affiliates, licensors, subsidiaries, contractors, managers, directors, employees, agents and subcontractors harmless from and against any and all damages, liabilities and other claims, actions, suits, losses, costs and expenses (including court costs and attorneys' fees to the extent reasonable) brought by or arising from any third party that is a direct or indirect consequence of any of the following:

1. Negligent acts, omissions, or willful misconduct on your part;

2. Access and use of the app on your part;

3. Upload or distribute content through the App by you;

4. Violation of these GTC by you and/or

5. Violation of laws or third party rights on your part.

 

 

11 Severability Clause. If any part or parts of this Arbitration Agreement are invalid or unenforceable under law, such parts shall be ineffective and severed, and the remainder of the Arbitration Agreement shall continue in full force and effect. If a court determines that any of the above provisions in the arbitration agreement are invalid or unenforceable because they would prevent the exercise of an unwaivable right to seek injunctive relief, all disputes regarding entitlement to such relief (and only such relief) must be severed from the arbitration and may be litigated in court. All other disputes subject to arbitration under the terms of the Arbitration Agreement shall be arbitrated under the terms of this Agreement.

8. TERMINATION AND REMEDIES

​

These Terms will begin on the date you accept them (as described in the preamble) and will continue until terminated in accordance with the terms herein.

You can delete your account at any time by logging into the app, opening the Settings tab (the gear icon) and following the instructions to close the account. Please note: If you delete your account, your subscription will continue until the end of the subscription period for which the corresponding fees were paid, and you will have 

In the event that baesh determines, in its sole discretion, that you have violated any part of these Terms, misused the App, or otherwise engaged in conduct inappropriate to the App, baesh reserves the right to: (a) warn you by email (to any email addresses you have provided to baesh) that you have violated the Terms; (b) delete your User Content; (c) terminate your Account; (d) terminate your subscriptions without refund; (e) notify and/or send your User Content to the appropriate law enforcement authorities and/or fully cooperate with them for further action; and/or (f) take any other action baesh deems appropriate. You agree that all terminations for cause will be made in baesh's sole discretion and that baesh will not be liable to you or any third party for any termination of your account.

Termination of these Terms or your Account includes removal of access to your Account and all related information and content associated with or contained in your Account.

 

9. MISCELLANEOUS

A few things we need to address before you can get started on baesh!!!

These TOS, which we may amend from time to time, constitute the entire agreement between you and baeshdar. The TOS supersede all prior agreements, representations and understandings (oral or written) between us, except for the Privacy Policy. Nothing in this clause is intended to limit or exclude liability for fraudulent misrepresentation.

Baesh has taken reasonable steps to ensure the usability, availability, accuracy and completeness of the information available at baesh and provides this information on an "as is" basis. The use of baesh and the content published there is at the user's own risk. baesh is not responsible for any loss caused by the transmission, use of data or inaccurate member content.

You are responsible for taking all necessary precautions to ensure that any content you receive through baesh does not contain viruses or other harmful components. You accept that baesh may not be uninterrupted or error-free, that defects may not be corrected, and that bash or the server through which you access the Service may contain viruses or bugs, spyware, Trojan horses or other similar malicious software. baesh is not responsible for any damage to your computer hardware, software or equipment, including, without limitation, damage caused by a breach of security or by viruses, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure, or other technical or other failure.

 

 

baesh will continue to develop and this might require adjustments. Therefore, we reserve the right to amend or modify the TOS at any time ("Amendment"). When we make Changes, they will be posted on this page and we will indicate that by updating the effective date at the bottom of the TOS. In certain circumstances, we may send an email to notify you of Changes. We may also ask you to agree to our changes, but we'll let you know. However, please check this page regularly to keep up to date with any changes.

Your continued use of baesh after changes to the TOS constitutes your acceptance of those changes and you are legally bound by the updated TOS. If you do not accept a change to the TOS, you should immediately stop using baesh (which may be quite difficult!).

Additional items:

If any part of the TOS is for any reason held by any jurisdiction to be unlawful, void or otherwise unenforceable, such part shall be removed from the TOS. The remainder of the TOS shall continue in effect and be binding and enforceable.

The App may contain links to third-party websites or resources. In such cases, you acknowledge and agree that we are not responsible or liable for:

1. The availability or reliability of such websites and sources; or

2. the content, products and services available through these websites and sources.

The existence of links to such websites or sources does not constitute an endorsement by us. You acknowledge that you are solely responsible for your use of such websites and sources and bear all risks associated therewith. Framing, hotlinking and other methods of embedding the App are expressly prohibited without our prior written permission.
